About The Book

This Book is considered one of the highest Hanafi Fiqh references. It spreads in 30 volumes where each volume covers a certain issue in Fiqh (Islamic Jurisprudence). The 30 volumes are gathered in 9 books.

The Issues discussed by the author cover many different subjects all based on Hanafi Fiqh. The author's discussion comes in an easy style, clear statements, and full explanation for rules and evidence. Through the series, the author establishes a comparison between the Hanafi Madhab and other Madhabs especially the Shafi'i madhab and the Maliki one.
 

المبسوط كتاب في الفقه على المذهب الحنفي ، استوعب فيه المؤلف جميع أبواب الفقه بأسلوب سهل ، وعبارة واضحة ، وبسط في الأحكام والأدلة والمناقشة ، مع المقارنة مع بقية المذاهب ، وخاصة المذهب الشافعي والإمام مالك ، وقد يذكر مذهب الإمام أحمد والظاهرية . 

وطريقة المبسوط أن يذكر المؤلف المسألة الفقهية ، ويبين حكمها على المذهب الحنفي ، ثم يستدل لها ، ثم يذكر آراء بعض المذاهب المخالفة ، ويشرح أدلتها ، ثم يناقش الأدلة ، ويرد عليها بما يراه الحق ، وقد يجمع بين أدلة الحنفية وأدلة المذاهب الأخرى المخالفين لهم جمعا حسنا ، يبعد التعارض . 

وهذا الكتاب شرح لكتاب " الكافي " للحاكم الشهيد محمد بن محمد المروزي ( 334هـ ) إمام الحنفية في وقته ، وقد جمع في " الكافي " كتب ظاهر الرواية للإمام محمد بن الحسن في فروع المذهب الحنفي . 

والمبسوط كتاب قيم ومفيد ، وهو أوسع الكتب المطبوعة في الفقه الحنفي ، والفقه المقارن ، ويعتمد عليه الحنفية في القضاء والفتوى ، وفي التدريس والتصنيف . 

وكان السرخسي قد ألفه كله أو جله إملاء من ذاكرته ، وهو سجين في بئر في أوزجند بفرغانه ، وقال في مقدمته : " فرأيت الصواب في شرح المختصر ، لا أزيد على المعنى المؤثر في بيان كل مسألة ، اكتفاءا بما هو المعتمد في كل باب ، وقد انضم إلى ذلك سؤال بعض الخواص من أصحابي زمن حبسي ، حين ساعدوني لأنسي ، أن أملي عليهم ذلك فأجبتهم "  

About the Author

Abi Bakr Mohammad Ibn Ahmad Al Sarkhasi or Al Sarakhsi, hails from the ancient city of Khorasan, also called Sarakhs. There is no information about his childhood or family background. Most Authors agree that he died in the year 1090 A.D. / 483 H. Al Sarkhasi wrote many books on Islamic Jurisprudence. His Siyar al Kabir is a series spread over either 4 or 5 volumes. His most famous work "Mabsoot" or "Mabsut", a commentary of shaybani's work is spread over 30 volumes. His other important work, Usul al-Fiqh consumes 2 volumes. 

He was thrown into prison for Criticising the King, and questioning the validity of the king's marriage to the slave woman of a palace servant. Al Sarkhasi authored parts of Mabsut and most of Siyar al Kabir in prison. After 15 years of captivity he was released from prison, and died soon after completing Siyar al Kabir. 

Al Sarkhasi is widely known as the "Hugo Grotius of the Muslims". Al Sarkhasi is greatly admired for his phenomenal memory as evidenced from his accurate recollection of the classics while being held in prison. Al Sarkhasi was a strong advocate of the doctrine of istihsan, which he describes as abandonment of systematic reasoning of the scriptures in favor of a different opinion supported by stronger evidence and more accommodating of the population's needs. However, Imam Sarkhasi's istihsan is also bound by certain criteria and conditions which accompany reasoning of any kind.
